CITY OF LOS ANGELES MANDATORY EARTHQUAKE REDUCTION IN EXISTING BUILDINGS

The City of Los Angeles has passed Ordinance 18393 that amends the Municipal Code to require mandatory earthquake hazard reduction in existing building. The following is an overview of the Ordinance. To read the entire ordinance, click here.

There are different compliance requirements and time limits for wood-frame and concrete frame buildings. Here is a short summary:

DIVISION 93 WOOD FRAME BUILDINGS:

Applicability:
All existing wood-frame buildings where:
  • the building permit application was made before January 01, 1978 and
  • there is tuck-under parking or other similar soft, weak or open front wall lines.

Compliance Requirement:
Owners must obtain a structural analysis of the building performed by licensed architect or structural engineer.
  • if the analysis confirms that the building complies with the requirements of the Division, no action required
  • if the analysis indicates that the building does not comply with the Division the Owner may
    • submit plans for structural alterations
    • demolish the building

Service of Order:
The City will serve an order to the owner if the building falls within the scope of the Division

Time:
  • Within 1 year of service of the order: Submit structural analysis and plans for structural alteration or demolition
  • Within 2 years of service of the order: Obtain permits for rehabilitation or demolition
  • Within 7 years of service of the order: Complete all rehabilitation work or demolition.

DIVISION 95 CONCRETE BUILDINGS:

Applicability:
All concrete buildings(except detached single family dwellings or duplexes) where the building permit application was made before January 13, 1977.

Compliance Requirement:
Owners must obtain a structural analysis of the building (performed by licensed architect or structural engineer.
  • if the analysis confirms that the building complies with the requirements of the Division, no action required
  • if the analysis indicates that the building does not comply with the Division the Owner may
    • submit plans for structural alterations
    • demolish the building

Service of Order:
The City will serve an order to the owner if the building falls within the scope of the Division

Time:
  • Within 3 years of service of the order: Submit to the City a completed checklist for review and approval
  • Within 10 years of service of the order: Submit evaluation of the building to include one of the following:
    • proof that the building was previously retrofitted to comply with LA Building Code or the requirements of this Division
    • Structural engineer’s report/analysis to show that the building meets the requirements of this Division
    • Structural analysis and plans for alterations to meet requirements of this Division
    • Plans to demolish the building.

  • Within 25 years of service of the order: Complete all rehabilitation work or demolition.
